Terms of Use
Effective Date: October 16, 2026
These Terms of Use govern use of the UseStaySafe.com website, the Stay-Safe prototype application, Stay-Safe SMS communications, and related prototype services.
By using the website or prototype, or by agreeing to receive Stay-Safe SMS messages, you agree to the applicable portions of these Terms.
Stay-Safe is currently under development and is being provided for prototype testing and customer validation.
1. Prototype Status
Stay-Safe is a developing personal safety-backup concept.
Features may be incomplete, experimental, unavailable, modified, reset, or discontinued. Prototype information may be lost during testing or development.
The prototype should not be relied upon as the sole method of storing information, contacting another person, obtaining assistance, or responding to an emergency.
2. Not an Emergency Service
Stay-Safe is not a 911 service, emergency dispatch service, law-enforcement agency, medical provider, rescue service, security company, or staffed professional-monitoring service.
Stay-Safe does not guarantee that emergency services will be contacted.
If immediate emergency assistance is needed, call 911 or the applicable local emergency number directly whenever possible.
3. User Responsibilities
Users are responsible for:
- Entering accurate contact information
- Keeping contact information current
- Obtaining a contact's consent before enabling SMS notifications to that person
- Selecting appropriate Stay-Safe contacts
- Understanding which contacts are assigned to each workflow
- Maintaining access to the user's device and account
- Granting required permissions where the user chooses to use a feature
- Testing prototype features before relying on them
- Maintaining independent copies of important information
- Using Stay-Safe only for lawful purposes
A person should not be added as an SMS notification contact unless that person has agreed to receive Stay-Safe messages.
4. Safety Events
Stay-Safe may provide user-initiated features such as Check-In, Quick Check-In, Get Assistance, Memory Log, and related contact notifications.
The user remains responsible for activating, reviewing, extending, resolving, or ending a safety event as appropriate.
Stay-Safe does not guarantee that:
- A safety event will activate successfully
- A timer or reminder will operate without interruption
- Location will be available or accurate
- A message will be delivered
- A recipient will read or respond to a message
- A contact will be available or able to help
- A device will remain powered, connected, or operational
- The prototype will continue operating after being closed, locked, updated, or interrupted
5. SMS Terms
By opting in to the Stay-Safe SMS program, the recipient agrees to receive non-marketing safety, status, service, consent, and testing messages from Stay-Safe.
Messages may include:
- Contact-consent or enrollment confirmation
- Check-In start notifications
- Successful Check-In completion notifications
- Overdue Check-In alerts
- Quick Check-In notifications
- Get Assistance notifications
- Safety-event escalation or resolution updates
- Service or support messages
Message frequency varies based on user-initiated safety events and prototype-testing activity.
Message and data rates may apply.
Reply STOP to opt out.
Reply HELP for help.
Carriers are not liable for delayed or undelivered messages.
Consent to receive SMS messages is not a condition of purchasing a product or service.
Opting out of SMS may prevent a recipient from serving as an active Stay-Safe SMS notification contact.
6. SMS Consent
SMS recipients must provide consent before Stay-Safe sends applicable messages.
During prototype testing, consent may be obtained verbally before the recipient's number is entered as an enabled Stay-Safe notification contact.
Future versions may provide an electronic contact invitation and acceptance process.
The person configuring a contact must not enter or activate another person's mobile number without that person's knowledge and permission.
Consent applies only to Stay-Safe messages consistent with the disclosed safety and status purposes.
7. SMS Support
For SMS help:
- Reply HELP to a Stay-Safe text message
- Email [email protected]
Opt-out requests sent by replying STOP will be processed through the SMS provider's applicable opt-out controls.
8. Acceptable Use
Users may not use Stay-Safe to:
- Send unlawful, deceptive, threatening, abusive, or unsolicited communications
- Add contacts who have not agreed to receive messages
- Harass or impersonate another person
- Falsify a safety event
- Interfere with the website, prototype, SMS service, or related systems
- Attempt unauthorized access to another user's information
- Use the service for advertising or bulk promotional messaging
- Violate applicable law, carrier requirements, platform requirements, or third-party rights
9. Location and Device Permissions
Some Stay-Safe features may request access to device capabilities such as:
- Location
- Microphone
- Camera
- Notifications
- Local storage
The feature may not operate properly if the necessary permission is denied, removed, or unavailable.
Location information may be delayed, unavailable, or inaccurate because of device, environmental, network, or service conditions.
10. User Content
Users may provide text, voice recordings, photos, contact information, Memory Log entries, and other content.
Users retain responsibility for the content they provide and must have the right to provide it.
Users should not upload unnecessary sensitive information during prototype testing.
11. Intellectual Property
The Stay-Safe name, branding, website, prototype, designs, text, workflows, and related materials are owned by or licensed to Stay-Safe unless otherwise stated.
These materials may not be copied, sold, distributed, or used to create a competing service without authorization, except where applicable law permits otherwise.
12. Third-Party Services
Stay-Safe may rely on third-party providers for hosting, application functionality, SMS delivery, email, analytics, location, storage, and other services.
Stay-Safe is not responsible for interruptions, limitations, policy changes, errors, or failures caused by third-party services.
13. No Warranties
The website, prototype, SMS program, and related services are provided "as is" and "as available."
To the maximum extent permitted by law, Stay-Safe disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and error-free operation.
14. Limitation of Liability
To the maximum extent permitted by law, Stay-Safe will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of, or inability to use, the website, prototype, SMS program, or related services.
Nothing in these Terms excludes liability that cannot legally be excluded.
15. Changes or Termination
Stay-Safe may modify, suspend, restrict, or discontinue any prototype feature or service.
Stay-Safe may update these Terms as the prototype, SMS program, and services develop.
The current effective date will be displayed at the top of this page.
16. Governing Law
These Terms are governed by applicable laws of the State of Michigan and the United States, without regard to conflict-of-law principles, except where another jurisdiction's law must apply.
